Legislation doesn't allow things. It attempts to either (a) prohibit or
(b) mandate.
A nice simplistic answer which ignores the effects of tax laws, the effect
of regulations in limiting what outsiders can do to affect the regulated
entity (consider electricity, and natural gas companies for example) and
what happens in the real world. Linux and the *BSDs could not exist
without laws, but neither could Microsoft. Without traffic laws, you
don't get working roads either. Sadly, the pretense that laws only
prohibit or mandate is just that a pretense that ignores what laws actually do.
I'm taking this offlist, in case anyone is interested.
Wayne
