Most of the commercial products are not. My understanding is that the mere fact of encryption gets their attention. 

 

Interesting question: Our company is required, by a number of government agencies, to encrypt communications for HIPAA compliance. Philadelphia CBH uses PGP; the rest don't care which. We use a less robust SPX system for those because it was the best compromise which I could find between security and ease of use (because sender and recipient buy in is most essential).  I am sure there is some back door for not only the NSA, but other government agencies. So what does that say about the efficacy of HIPAA?
