Good point.  I remember the the carriers upset about this and part of the "fix" with ICS was to add some infrastructure to allows carriers to control tethering abilities.

I thought however that that when away again after ICS but the deal was that only the Nexus line would be unrestricted?  I thought T-mo was one of the carriers that allowed it.

It may also depend on the version of the Android OS. When my phone was on honeycomb, I could tether freely, but after an over the air upgrade to ICS, I suddenly needed a tethering subscription until T-Mobile changed their plans to include it without penalty.
