I know this is way over simplifying things, but can't you just claim
that you developed the code in question *before* you became an employee?
1) Can you prove it?
2) Did you stop work on it when you started working for $EMPLOYER ?
In any case, Cover Your Assets. Get it on paper. It's not as hard as
you might think.
I agree, but can the employer provide any proof to the contrary?
