Having now read 18 U.S.C. 1030, I can say that it doesn't actually
help your argument at all.  It makes no mention of using someone's open
AP.  It is about using or accessing computers or networks for criminal
activities, with a large focus on crimes targetting US government or
financial institutions.  It makes no mention at all of home networks,
and it even sets lower bounds on damages and intent even when accessing
government networks.

However, I am in agreement that there's probably no point in going on
with this thread.  This will probably be it for me.
