I believe the patents in question cover FAT32 only.  That was introduced in Windows 95 IIRC so it's new enough to still be covered by patents.

What I'm waiting for is IBM's response to this.  They have a patent library that could easily go up against MS.  The only thing is that the usual cross-licensing agreement wouldn't work, since Linux isn't owned by a single company.
