This would be exactly the problem with more regulation.  If you invite the FCC to start dictating who is allowed to do what with their own property do you think it will be the entrepreneur with a great idea who will bow before a civil master to beg to deliver a unique service, or is it more likely that the companies most willing to bribe and cheat will move in to "make a killing" by getting exclusive rights to something from a bureaucrat.

If you don't like comcast and and Verizon, that's fine, but don't get out your pitchforks and go take over.  Just take your business elsewhere.
