If it is definitely on com 1 (/dev/ttyS0) then:
$ ln -s /dev/ttyS0 /dev/modem
*should* work.

If it's a winmodem, I'd check http://www.linmodems.org to see if anyone out there got linux working with your modem .... I was able to find a driver for my winmodem on my laptop there. If not perhaps http://www.linuxdoc.org/HOWTO/Laptop-HOWTO.html (esp. Appendix E) may have info that can help you.
