This is not a matter of employment law -- employers can do what they want in PA -- but a matter of tax law. Benefits paid in a discriminatory fashion (i.e. employees must be treated equally) are included as income. This means that you can't pay certain benefits only to people at the top and still treat them as tax exempt benefits.
