I think hardware is the ultimate limiting factor, but of course you need the right OS, software, and drivers to get it to work. Look at this weirdness: <http://www.madge.com/_assets/downloads/lsshelp8.0/LSSHelp/AdvFeat/Promisc/P romisc2.htm>. These NICs have some software which allows "Permanently Disabling Promiscuous Mode."
