allowed to run servers or use "excessive bandwidth," according to the ToS. A

Well they specifically talk of company based mail and web servers on their business web page.

There is a difference between a "company" based service and a reseller's service.

It may seem like a legal hair, and it is. But the TOS stuff frequently makes an explicit reference to the difference.
