Which ruling?

The one which I heard about briefly the other day upheld the RBOCSs 
position ... They do NOT have to provide access to their Data and Fibre 
structures for competitive carriers.

However, I don't believe that this was related to the last mile at all, 
but rather CO to CO.  ... I haven't read more than a two sentence 
summary of it so far (and that from a general interest newspaper.)
