Actually if I'm not mistaken(i could be though because I'm in a hurry) and according to slashdot they are. RIAA is after everything alt.binaries. We are hoping that it is going to end up being a safe harbor because of all the ligament stuff it does. However, when you have companies selling retention and access to binaries, binaries, mp3 ...etc left and right it makes RIAA's case much stronger. They have already won the argument that if you host it you are responsible even if you users put it up there. The only way you can protect your business as a host is if you taken it down once the host receives a removal order, on a per incident basis.

While it may not concern some, respect for copyright is an integral part of
Free software's history of success. Please don't advocate the illegal
copying of unlicensed software on the list, it reflects poorly on all of us
here.

Also worth noting is that the RIAA, nasty as they may be, won't be doing
anything about illegal software on USENET. Apple, its partners, and its
lobbying groups are just as belligerent as the RIAA when it comes to you
sharing their software. That is something to keep in mind the next time you
have the choice of supporting them by buying their products.
